TERMS & CONDITIONS:
ONE: Through this agreement, the Member accepts the Terms and Conditions stipulated by ESSENTIAL PASS. This Travel Membership may include the following benefits, however not exclusively limited to these:
A: Access to the ESSENTIAL PASS Membership. The Member will have access to a Database of Hotels, Commercial or Private Flights, Boat Rental, Cruises, Car Rental, Private Properties, and All the services available in the Booking Engine of ESSENTIAL PASS and Fulfillment Companies, at Discounted Rates. ESSENTIAL PASS Guarantees the Best Hotel Rates. Which by signing this agreement The Member Accept each and every one of the conditions as described in the webpage www.essentialpass.com
B: Hotel Best Price Guarantee. Reserve a vacation through your membership and if you find cheaper pricing anywhere else, simply submit a claim within 24 hours from booking and we promise to credit you 110% of the difference. Terms and Conditions Apply (See Website). Promotions directed to Travel Agents and Employees of the Tourism and Aviation Sector are Excluded.
All services provided by ESSENTIAL PASS, are subject to reservation, refund and cancellation rules defined by the Final Service Provider, and will be informed to the Member prior to its purchase. All services offered are subject to availability, therefore no vacancy or price guarantees.
TWO: Activation. The Membership will be activated 10 days after the date of signature; however such activation is related to the payment of the corresponding fee by the Member. The use of this ESSENTIAL PASS Membership will be restricted to the Members and Beneficiaries listed on this application.
THREE: Membership Fee. The Member will pay for the ESSENTIAL PASS Membership Subscription a amount in USD, or its equivalence in Mexican Pesos, in accordance with the official exchange rate published by the Bank of Mexico in the Official Newspaper at the payment date. The ESSENTIAL PASS Membership authorizes the Use and Enjoyment of All Benefits, up to Eight Persons in Total (Owner, Co-Owner and 6 Beneficiaries of Use).
There is an Annual Renewal Fee. The cost is $ 199 USD Annual. The fact of not being current in the payment of the Annual Renewal will be reason for the immediate suspension of the Service.
FOUR: Length and Renewal. The Use of the Available Services in the Booking Engine ESSENTIAL PASS Membership, and Fulfillment Companies, has an Initial Term of 12 Months, counted from the Date of the Signature of the Present Agreement. At the End of the 12 Months, the Membership may be renewed, in accordance with the Annual Renewal Fee Rates, Effective on the Date of such Renewal.
FIVE: Reservations. The Member, in order to be able to Use the Services Offered in this Agreement, must contact ESSENTIAL PASS, and must pay the amounts involved, when using these Services.
SIX: Contact Information. The Member agrees to provide contact information to ESSENTIAL PASS and Associated Companies, so that they may use it in an appropriate manner to provide the Travel Services mentioned above. This Information will be protected by the Applicable Laws of Protection of Personal Data, and may not be distributed to another entity, without the Member Authorization.
SEVEN: Behavior. It is forbidden to have an ESSENTIAL PASS Membership for Commercial Purposes. The Member should limit the use of this Membership to the Persons listed in this application. The ESSENTIAL PASS Membership will be Canceled if Commercial Use is detected, the Exchange of Information about ESSENTIAL PASS Prices with Third Parties (including Hotels, Airlines, and other Similar Companies), or inappropriate conduct towards ESSENTIAL PASS Employees or Affiliated Companies. No refunds will be made for behavioral cancellations.
EIGHT: ESSENTIAL PASS will not be responsible for any extra cost, evacuation or inconvenience that may arise from a Tropical Storm, Hurricane, or Natural Disaster. ESSENTIAL PASS is exempt from any liability related to any service that is NOT expressly described in these Terms and Conditions.
NINETH: ESSENTIAL PASS reserves its right to admit New Members or Renew Memberships.
TEN: Address. For any type of claim arising from the signing of this agreement, the parties establish as domicile the one located at: Carretera Costera Sur Km. 3.5, Zona Hotelera Sur, 77600, Cozumel, Quintana Roo, México. Email: [email protected]
ELEVEN: The parties submit to the Judges and Courts of the City of Cozumel, Quintana Roo, México, for the interpretation and fulfillment of this agreement, waiving any other, that by their present or future domiciles will come to correspond.
